Repudiation & Disavowal (Limited Liability Commitment)
The limited liability commitment is a formal disclamation of terms of services and other key areas that are offered to the Clients/Customers or Users/Visitors during the travel arrangements. Such limitations of liabilities ensure smooth transition of services and enhanced transparency between “Us” (including but not limited to Our Affiliates, Online/Off Line Brands, Subsidiaries and Associated Companies). However, this commitment forsakes and abrades off the Terms of Services and travel arrangements made by either direct/indirect involvement of 3RD Parties viz-a-viz Flight Ticket Suppliers, Airlines, Car Rental Providers, Hotels and Resorts Owners, Food Brands, Equipment Vendors and all other Independent Contractors thereof.
Primary Ownership/Proprietorship
We are a Limited Liability travel company offering global travel arrangements viz-a-viz flights booking, hotel reservations, and destination management to our customers/clients. We have private ownership and accountability of our businesses for establishing qualitative ownership of travel bound services and arrangements.
The business is operated and managed under the able leadership of Christopher, and supported by members constituting as “Board of Directors of MyTripMyFare.” The business maintains transparency with regular board meetings on regular intervals at registered official premises.
Disavowal of Liabilities and Travel Services
We do not take accountability of services and all-inclusive travel solutions offered to the Clients/Customers through direct/indirect involvement of 3RD Parties, Flight Ticket Suppliers, Airlines, Car Rental Providers, Hotels and Resorts Owners, Food Brands, Equipment Vendors and all other Independent Contractors thereof.
In the process of delegating services in the capacity of tour & travel consultant and travel agency, we promote and manage bespoke packages, which also include all-inclusive travel arrangements. The packages and travel arrangements offered by “Us” are transitioned through 3RD Party Service Providers and several independent contractors. We do not have any rightful control over the services offered or rendered to our Clients/Customers by such contractors.
Expanse and Authority of Travel Arrangements
We have right to make adjustments/revisions in travel itinerary, flight itinerary, hotel for smooth disbursal of a trip and better management of travel services in accordance, and to accommodate specific requirements of the Clients/Customers. We are not held responsible or accountable for any Injury/Harm/Damage caused to Clients/Customers out of sheer mismanagement or last minute changes made by 3rd Party.
We own the responsibility of amount(s) received from Clients/Customers for making any travel arrangement. However, we shall not be held liable for the Taxes and Fees charged by Suppliers and 3rd Party Service Providers or Independent Contractors. Such supernumerary monies transacted during any travel arrangements and added to base charges are consequential and decisive of the Suppliers and 3rd Party Service Providers or Independent Contractors.
Supposition of Risks Incurred by Clients/Customers
Clients/Customers or Users/Visitors visiting the website will deliberately and voluntarily assent to services/offers made on the website for omni tour arrangements. In furtherance, Clients/Customers or Users/Visitors visiting the website shall acknowledge to perceptible and non-perceptible risks and dangers involved in tour/trip but not having any limitations to:
Physical toil and drudgery;
High altitude excursions;
Natural distresses such as hurricanes, floods, high winds, quakes and volcanic eruptions;
Human outages;
Missing or displaced luggage;
Cancellations or Alterations in Trip due to Over Bookings;
Civil turmoil, intimidation, terrorisation, extremism, or any kind of criminal activity;
Imminent dangers or risks involved from wild and/or domesticated animals;
Limited medical services, including hospitalisation and receivable primary & secondary healthcare;
Limitation of the Travel Insurance Plans and Services offered under the Plan;
Intake of Alcoholic beverages & cannabinoids;
Booking flights, train car, bus, and destination detours.
Dismissal from Obligatory Liabilities
Clients/Customers or Users/Visitors visiting the website maintains consciously that all travel arrangements and trips made through “Us” shall offer gratification and delight but shall also have inherent perils, unlike the safety and comfort of life and living in home.
The Clients/Customers or Users/Visitors shall take objective view of inherent risks as these have contributing factor in leading to the excitement & enjoyment. Consequently, the Client/Customer or User/Visitor planning for any Trip/Tour Plan shall agree in full conscience their own welfare and imminent risks involved.
The Client/Customer or User/Visitor shall exonerate and free “Us” from and against all sorts of liabilities associated with trip/tour except the liabilities that may least likely to occur from our negligence. Such Dismissal from Liabilities of MyTripMyFare shall become obligatory and legally tethered to the Client/Customer or User/Visitor and also all accompanying members, including minors, heirs and inheritors besides the representors, on an equal keel.
The Clients/Customers or Users/Visitors shall also testify to the facts that medical services or facilities available in destination are not dispensed instantly, and that their availability is limited and restricted during the course of trip. It is advisable that Client/Customer should procure a legit Travel Insurance handy with them, and this is the obligatory responsibility on part of every Client/Customer or User/Visitor making travel arrangements from MyTripMyFare. The Client/Customer shall also own the responsibility and accountability for their:
Health and well-being;
Flight/travel itinerary and pre-departure essentialities;
Clothing and equipment as desired and recommended for destination;
Any last minute changes in the travel plan
Any Client/Customer or User/Visitor visiting the website should acknowledge the fact that we have the final obligatory rights for cessation of trip, exclusion of the Client/Customer from tour plan, provided that such a Client/Customer is NOT CAPABLE OF ADHEREING TO THE NORMS OF THE POLICIES AND OUR POLICY FRAMEWORKS.
The Clients/Customers or Users/Visitors visiting the website should hold obligatory allegiance to written and verbal rules for maintaining the safety standards and due diligence as considered essential and mandated by 3rd Parties and our business associated and affiliates.
Since “We” are the registered Tour Operators, We have obligatory rights to cancel, modify flight bookings, hotel reservations, and all-inclusive trips in accordance and aligning to the comforts of our Clients/Customers or Users/Visitors.
Payments for Services/trips/Tours/Travel Arrangements
All payment transactions made for omni tour and travel services including the Services and Taxes shall be in the name of respective suppliers, who are offering them. The payments are likely to change depending on the prevailing economic conditions and the tariff plans adjusted by the suppliers. The overall price of tour may increase due to currency fluctuations, fuel surcharges, airport fees, airfare changes, alterations in the hotel tariffs etc. impromptu and Clients/Customers or Users/Visitors have to bear additional costs incurred on tour plan.
NB.: Since we do not validate these changes, therefore we are not accountable for any price changes or currency variations.
Allegiance and Exclusion from Intellectual Copyrights
We have the sole ownership of the Logo/Graphics and the textual content on the website. Any entity that shares or breaches the copyright shall become liable for obligatory legal actions and adjudications in respective court of laws under which the jurisdiction falls.
We do not claim any responsibility and accountability for graphics, logos and text that appears on the websites or printed material of 3RD Parties viz-a-viz Flight Ticket Suppliers, Airlines, Car Rental Providers, Hotels and Resorts Owners, Food Brands, Equipment Vendors and all other Independent Contractors thereof.
The Clients/Customers or Users/Visitors shall is not binding for any modification, or copying, distribution, or transmitting, or displaying, or reproduction, or publishing, or licensing or creating any form of derivative works, and this also includes the act of transferring, or selling, any information or travel services listed on our website , or the website of our affiliates and business partners.
NB.: The Clients/Customers or Users/Visitors shall not contest any legal battle/claim against us or any or our associates or affiliates under any circumstance. We denounce all such claims and adjudications, irrespective of where these are enforced or adhered to by the law of lands.
Content and Printed Information on the Website
We make deliberate effort in ensuring that the content published on our website and that or our affiliates and partners is correct and updated, but we do not take complete accountability of these updates and correctness of content under any condition.
We do not operate or own the airlines, hotels and other services, and therefore do not control or prevent fluctuations in the published descriptions or prices. We have full obligatory rights over the changes and alterations in the order that Clients/Customers or Users/Visitors places on our website for using our services. Such changes shall be delegated to Clients/Customers or Users/Visitors within reasonable framework of time.
Unlawful Use of Website and its Content is Strictly Prohibited under the Policy Frameworks
The Clients/Customers or Users/Visitors visiting the website ATTESTS TO THE FACT THAT NO PART OF THE WEBSITE SHALL BE USED WHICH IS DEEMED AS UNLAWFUL OR ILLEGAL MEANS. Grievances & Objections of Clients/Customers
If any Client/Customer or User/Visitor visiting the website has any grievance in respect of travel arrangements proffered by “Us”, the same can be notified to us within 48/72 hours from the time such a Client/Customer or User/Visitor has purchased the service. We are committed to providing reprisal against any genuine grievance or complaint brought to our sight within the notified time. Implied Warranties & Jurisdictions
We explicitly deny the legal and para-legal warranties obligated under various laws of the land and applicable under different jurisdictions across the globe. In the event whereby the Users / Clients/Customers/Visitors show any non-agreement to provisions of the disavowals and disclaims, it is therefore advisable that such Users / Clients/Customers/Visitors have no rights whatsoever to use the services offered on our website.
Likewise, the Users / Clients/Customers/Visitors agree explicitly that they may use any or all the travel related services and the written and published content solely at their own risk. The list of travel services offered by “Us” through the website has the nature of “AS IS” and “AS AVAILABLE” AND WE CANNOT ASSURE YOU OF THEIR AVAILABILTY THROUGH AND THROUGH.
We can also alter the features and terms of travel services without sending any explicit or proper notice to the Users / Clients/Customers/Visitors.
